Qualcomm submits a defense against Apple's lawsuit and filed a counterclaim

- Highlights Apple’s behavior in an attempt to devalue the value of Qualcomm’s core technology that empowers the iPhone—

San Diego, USA, April 10, 2017 – Qualcomm Incorporated (NASDAQ: QCOM) filed a defense today and filed a countersuit against Apple in a lawsuit filed with Qualcomm in the Southern District of California in January this year. In its submission, Qualcomm details the value of the technology that Qualcomm invented, contributed, and shared with the industry through licensing programs, and noted that Apple failed to negotiate with Qualcomm in good faith to obtain fair, reasonable, and non-discriminatory conditions. Use Qualcomm's 3G and 4G standard essential patent licenses. The lawsuit pointed out that Apple:

· Violation of the agreement with Qualcomm, misinterpreting the agreement and negotiation with Qualcomm;

· Interfered with the long-term agreement between Qualcomm and Qualcomm licensees who manufacture iPhones and iPads for Apple;

· Encourage regulators to attack Qualcomm's business in different parts of the world by misinterpreting facts and providing false statements;

· Choosing the performance of Qualcomm modem chips not fully utilized in their iPhone 7 phones, misinterpreting performance differences between Qualcomm modems and different iPhones with other vendor modems;

· Threat Qualcomm and attempt to prevent it from making an open comparison of the superior performance of iPhones equipped with Qualcomm products.

Qualcomm filed multiple claims, including asking Apple to pay damages for breach of the promises in several agreements, and asked the court to order Apple to stop interfering with Qualcomm's agreement with Apple's makers of iPhones and iPads.

Qualcomm executive vice president and general counsel Don Rosenberg said: "Qualcomm is a global leader in the invention and development of basic, breakthrough mobile technologies. It is these mobile technologies that have driven the global mobile ecosystem to flourish. Today, Qualcomm's patented technology remains the driving force behind the value of mobile terminals. The value of our invention has been achieved over the past three decades through hundreds of license agreements negotiated and negotiated with almost all major handset manufacturers. It is well documented that this includes agreements with Asian manufacturers that produce iPhones and iPads for Apple. Over the past decade, Apple has brought the benefits of mobile communications technology to its popular products and services. Consumers have played an important role in the process. However, without relying on Qualcomm's core cellular communications technology, it is impossible for Apple to build such a successful iPhone series phone, and it is unlikely that it will become the most profitable company in the world and acquire it. More than 90% of the profits of the entire smartphone industry. Now, after 10 After the historic development, Apple refused to recognize the widely recognized and sustainable value of these technologies. Apple launched an attack on Qualcomm around the world and tried to use its huge market influence to coerce Qualcomm to accept unfair and unreasonable Licensing Terms. We will actively defend our business model and protect the right to fair value due to Qualcomm's technical contribution to the industry."
